This Service Agreement (“Agreement”) is hereby entered into between LINKSYNC is a trading name of On Target Media a business registered in England with company registration number 06382030 (hereinafter referred to as “LINKSYNC”) and the party ordering from the LYNCSYNC website (“Client” or “you”) incorporated herein by this reference and applies to the purchase of all “Services” ordered by the Client.

Definitions

“Client(s)” or “You” – the company or person paying for LINKSYNCs services.

“Services” - include but not limited to, Obtaining “backlinks” from other websites, blogs and directories in order to generate link popularity.

“Backlink(s)” – website links from one domain to another.

“Fee(s)” – amounts charged by LINKSYNC to Client(s) in respect of all services.

“Target website” – being the website that a link is director to.

Terms of Service

Clients must acknowledge the following with respect to the services:

All fees are non-refundable.

Changes to completed orders and projects within orders, such as amendments to anchor texts and target URLs, may incur an admin fee of £20 per change, subject to the discretion of the LINKSYNC staff. Other changes to completed projects may incur other charges or requests may be refused by LINKSYNC.

All fees, services, documents, recommendations and reports are confidential.

LINKSYNC has no control over the policies of search engines with respect to the type of websites and/or content that they accept now or in the future. The Client’s website may be excluded from any blog, website, directory or search engine at any time at the sole discretion of the search engine or directory.

LINKSYNC has no control over website and blog owners removing links and content, or deleting/moving/changing their website. Refunds and replacements will only be processed per the refund policies of each individual service.

Under no circumstances shall LINKSYNC be liable to the Client or the target website owner for any damages whatsoever, including (without limitation) any direct, incidental or consequential damages, loss of profits, or any claims of yours or third party websites. The Client shall assume all risks and potential damages (known or unknown) associated with using LINKSYNC services.

LINKSYNC reserves the right to amend anchor text and other order details to ensure successful placements or completion of services.

LINKSYNC does not guarantee search engine position improvements or traffic increase as results of using LINKSYNCS services.

Any form of link building inherently incurs risks of search engine penalties and other damage to SEO efforts. LINKSYNC does not assume liability for any impacts of link building and other SEO activities upon the Client’s target website rankings.

LINKSYNC is not responsible for changes made to the website by other parties that adversely affect the search engine rankings of the Client’s website.

Confidentiality

LINKSYNC does not sign individual Non Disclosure Agreements for Clients using our services but use our best endeavours to keep Client data confidential.

LINKSYNC undertakes not to use the Confidential Information disclosed by Clients for any purpose except for providing the services purchased.

Restrictions

LINKSYNC reserves the right to cancel any orders placed for websites in illegal or offensive industries. Any illegal content, products, services or items hateful, objectionable or defamatory content aimed at any people group, race, gender, sexual orientation or otherwise attacks on any person, business, organisation, product or service; cruelty towards animals; or otherwise content found to be objectionable will be cancelled and refunded.

Pharmaceuticals, gambling, casinos, and adult orders may be possible but have to be treated separately and will be cancelled and refunded if no suitable blogger or directory can be found.

Disputes

In the event of any dispute arising out of the Agreement, the parties will attempt to settle it by negotiation. To this end, they shall use their respective best endeavours to consult or negotiate with each other, in good faith and, recognising their mutual interests attempt to reach a just and equitable settlement satisfactory to both parties. Negotiations shall be conducted between the respective senior executives of the parties who gave authority to settle disputes.

Communication

By purchasing LINKSYNC services, you agree to receive emails from LINKSYNC, which could be in the form of order notifications, system updates, new services, offers or educational material.

Jurisdiction

This Agreement shall be subject to and interpreted in accordance with the law of England and Wales whose courts of England and Wales shall have exclusive jurisdiction.
